What are the rights of employees against the harassment of employer ?

Harassment is common now in many companies all over the world, this can be anything, work-related, bullying, or sexual harassment. How can we tackle this and what are the rights of employees?

    Harassment is any unwelcome conduct based on color, race, religion, national origin, sex, older age, disability, or genetic information. Harassment can include offensive behavior such as offensive jokes, slurs, name-calling, and physical assault, among many others.

    If you are a victim of employer harassment, you may wonder if there are laws that can protect you. Here are some rights you have as an employee.

    1. You have the right to a discrimination-free workplace. This means that your employer cannot discriminate against you from getting the job based on your race, color, or sexual orientation.
    2. You have the right to complain about workplace harassment without the fear of being punished.
    3. Keep your medical information private. Your employer can only request limited medical information about you.
    4. You also have the right to request workplace changes because of your religious beliefs or disability.

    The primary rights of employees against the harassment of employer are:-

    1. Right to work in a healthy and safe environment.

    2. Right to be provided with the necessary facilities for their personal hygiene and cleanliness.

    3. Right against sexual harassment by their employers or other employees as well as by third parties.

    4. Right to get paid wages on time (wages earned should be paid within seven days after they are due).

    5. Right to get paid leave according to law, i.e., 30 days paid annual leave and 7 days paid sick leave per year, among others.

    The employee has the right to raise his voice against the harassment by his employer. The employer is also not allowed to threaten or harass the employee for raising his voice against the harassment.

    The answer to the question depends on the type of harassment that is being alleged.

    There are two types of harassment:

    1) Sexual harassment and

    2) Racial or religious discrimination.

    Sexual harassment can include unwelcome sexual advances, requests for sexual favors, sexual innuendo or other verbal or physical conduct of a sexual nature. It can also include a hostile work environment in which someone’s job performance is affected by repeated sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature. This conduct may be directed at someone because of his or her gender, even if it is not aimed at any particular individual.

    Racial or religious discrimination includes all forms of discrimination based on race, color, sex, age disability and religion. It also includes retaliation against an individual because he/she complained about discrimination or participated in an investigation regarding unlawful employment practices.

    The employee can approach a court of law for any kind of harassment or violation of human rights.

    A female victim of harassment can also file a complaint with the National Commission for Women (NCW), if she feels that she is being directly harassed by his employer.

    If she feels that she is being harassed by her co-workers, then she can approach NCW and get help from them.
