Hello Friends, I have been working as Assistant Professor at a private University for 14.5 years. After completing continuous 5 years of service, I have taken a total of 25 months LWP (Leave without pay) for personal work in different years which is duly approved by the organization. I am already eligible for gratuity but the organization has not included the LWP months. Can I claim the gratuity for LWP months too as leaves were approved?

Yes, in most cases, you can request gratuity for months of approved leave without pay (LWP), but it depends on the specific policies and regulations of your organization and the labor laws in your jurisdiction. Some companies and legal frameworks might treat periods of approved LWP differently when calculating gratuity entitlement.
It’s important to review your employment contract, company policies, and applicable labor laws to understand whether LWP months are eligible for gratuity and what conditions might apply. If you’re unsure, it’s recommended to consult with your HR department or seek legal advice to get a clear understanding of your entitlements in relation to gratuity during LWP months.
