In India, under the Maternity Benefit Act, no woman can be terminated from her service on the ground of her pregnancy.
That apart, no employee (both male and female) who has worked for 2.5 years cannot be terminated without any valid reasons even if such clause is mentioned in the appointment letter (being such clause void). Even if there is a reason (alleging any misconduct on the part of the employee) for termination the company has to provide enough opportunity to the employee for his self-defense before terminating his service.
If the above-mentioned conditions are not fulfilled, termination becomes illegal.
About termination, it’s not only about pregnant women , no one can terminate anyone without a proper reason . And in case of you have a proper reason, the company have to give a letter to that employee that you’re gonna get terminated after a weak or whatever the specific period is. This is professionalism. And about pregnant women they can get a temporary leave 1-2 months before their delivery and this is all decided long before.
Usually its answer is No!
On the professional grounds, there are some standards of terminating an employee.
The company has to give an warning letter to that employee before terminating them. This letter is issued before a certain time . That after this specific time he/she will be terminated. The same is the case with employes as well that if they want to resign they have to make the company aware of it before a certain time.
This is what we call professionalism.
And if we talk about a pregnant woman. So there is an agreement made between that woman and company that before atleast this much time before her delivery she will take a leave. As it is in the policies of company to safeguard the rights of their employees and to safeguard the maternity issues as well.
And specially that when that woman is working for 2.5 years so she must be an experienced and trustworthy employee of that company. So there are very less chances of terminating a pregnant women who is working for 2.5 years without any reason
